1. Acceptance of Terms

By accessing or using KlubHub ("the Service"), operated by GBA Solutions ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

KlubHub is a club management platform that enables organizations to:

  • Send notices and announcements to members
  • Create and manage events with RSVP functionality
  • Share documents and files
  • Facilitate group communication via chat
  • Collect payments from members
  • Manage member information and groups

3. User Accounts

3.1 Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Types

  • Club Administrators: Users who create and manage clubs. Responsible for club content and member management.
  • Club Members: Users who join clubs to receive communications and participate in club activities.

4. Subscription and Payments

4.1 Pricing

Club subscriptions are billed monthly. Current pricing is available on our website. We reserve the right to change pricing with 30 days notice.

4.2 Free Plan

The free plan allows clubs with up to 10 members. Exceeding this limit requires upgrading to a paid plan.

4.3 Cancellation

You may cancel your subscription at any time. Access continues until the end of the current billing period. No refunds are provided for partial months.

4.4 Payment Collection

Clubs using our payment collection feature connect their own Stripe account. We charge a transaction fee per payment processed. Clubs are responsible for their own compliance with Stripe's terms and applicable payment regulations.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Share content that is defamatory, obscene, or harmful
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service's operation
  • Upload malware, viruses, or malicious code
  • Harvest or collect user information without consent
  • Use the Service to send spam or unsolicited communications
  • Impersonate any person or entity

6. Content

6.1 Your Content

You retain ownership of content you post to the Service. By posting content, you grant us a license to host, display, and distribute that content as necessary to provide the Service.

6.2 Content Responsibility

Club administrators are responsible for content posted within their clubs. We do not pre-screen content but reserve the right to remove content that violates these terms.

6.3 Data Export

You may export your club's data at any time. Upon account termination, we will retain your data for 30 days before permanent deletion, unless you request immediate deletion.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by GBA Solutions and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

9. Third-Party Services

The Service integrates with third-party services including:

  • Firebase/Google Cloud: For hosting and infrastructure
  • Stripe: For payment processing

Your use of these services is subject to their respective terms and privacy policies.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, secure, or error-free.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GBA SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

12. Indemnification

You agree to indemnify and hold harmless GBA Solutions from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with notice. You may terminate your account at any time through the app settings or by contacting us.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms are governed by the laws of Ireland. Any disputes shall be resolved in the courts of Ireland.
